Anime Right News (ARN) – United States District Judge S. James Otero has dismissed Porn Star and Stripper Stephanie Clifford's, who goes by the name Stormie Daniels in the media, defamation lawsuit against President Donald Trump and ordered her to pay his legal fees. The president's legal team said his legal fees will be determined at a later date.
Miss Daniels was suing on POTUS for calling her statements about being threatened to not come forward with her alleged affair with President Trump "a total con job."
Daniels lawyer Michael Avenatti argued that the President's tweet "attacks the veracity of her account" of being threatened. He also made the claim that the above tweet was "false and defamatory, and that the tweet was defamation ... because it charged her with committing a serious crime," District Judge S. James Otero wrote in his Opinion.
Otero wrote in regards to President Trump's legal team asking for a dismissal of the case that "The Court agrees with Mr. Trump's argument because the tweet in question constitutes 'rhetorical hyperbole' normally associated with politics and public discourse in the United States. The First Amendment protects this type of rhetorical statement."
President Donald Trump's legal team released a statement about the dismissal today,
United States District Judge S. James Otero issued an order and ruling today dismissing Stormy Daniels' defamation lawsuit against President Trump. The ruling also states that the President is entitled to an award of his attorneys' fees against Stormy Daniels. A copy of the ruling is attached. No amount of spin or commentary by Stormy Daniels or her lawyer, Mr. Avenatti, can truthfully characterize today's ruling in any way other than total victory for President Trump and total defeat for Stormy Daniels. The amount of the award for President Trump's attorneys' fees will be determined at a later date.
In a previously deleted tweet from today Michael Avenatti, Miss Daniels' Lawyer stated,
Re Judge’s limited ruling: Daniels’ other claims against Trump and Cohen proceed unaffected. Trump’s contrary claims are as deceptive as his claims about the inauguration attendance.
We will appeal the dismissal of the defamation cause of action and are confident in a reversal.
He recently released another statement on twitter saying,
This case is separate from the ongoing legal battle between the two parties over a payment of $130,000 for alleged hush money to keep silent about an alleged affair. The results from this case do not affect the case dealing with the alleged affair between the Porn Star and the President.
